I. INTRODUCTION AND SCOPE
This privacy policy informs you about the processing of personal data by Particle Measuring Systems („PMS“). This privacy policy was last reviewed in October 2020 and may be changed over time. You are advised to check back regularly for changes.
PMS, located at 5475 Airport Blvd, Boulder, CO 80301, is the controller of all personal data of job applicants and prospective employees or temporary workers working under its supervision (e.g., trainees).
II. FOR WHAT PURPOSE DO WE PROCESS YOUR PERSONAL DATA?
We will process your personal data to (i) administer and manage recruitment processes and related policies and practices within PMS and (ii) communicate with you about your interest in employment with PMS. Please note that the recruitment process may include:

- Pre-employment screening
- Employment-related
III. ON WHAT LEGAL BASIS DO WE PROCESS PERSONAL DATA FOR THIS PURPOSE?
We process your personal data based on our legitimate interest in ensuring that PMS can evaluate and select candidates efficiently and effectively. Pre-employment screening of potential employees is conducted for security reasons or in relation to export controls, anti-bribery and corruption, ethics and compliance, and other legal or regulatory obligations to which we may be subject.
IV. WHICH PERSONAL DATA DO WE PROCESS FOR THIS PURPOSE?
For this purpose, we process your contact details (name, title, telephone, email, and home address), any information included in your cover letter or CV (such as your professional memberships, employment, and educational history), information you have posted on social networking sites (such as LinkedIn), and your correspondence with PMS regarding your application (including references). We may also process personal data necessary to assess your creditworthiness, demonstrate employability, and any previous unspent criminal convictions.
V. HOW LONG DO WE KEEP YOUR PERSONAL DATA?
We will retain your personal data for the duration of the recruitment period for the relevant position, unless you request us to retain your personal data for a longer period (e.g., so we can consider you for future job opportunities). If we retain your personal data for a longer period, we will only do so on the basis of your consent, which you may withdraw at any time and free of charge, or if required for mandatory reporting purposes.
VI. WHO HAS ACCESS TO YOUR PERSONAL DATA?
Within PMS, your personal data will only be made available to those who need access to the data and only to the extent necessary to fulfill the purpose stated in Section II (above). We will take appropriate measures to ensure that your personal data is adequately protected. Your personal data may also be available to ADP to conduct verification and background checks on potential recruits following a job offer. In other cases, your personal data will not be shared with third parties unless required by law.
When ADP processes your personal data on our behalf, it acts as a data processor, and we enter into an agreement with ADP to ensure, at a minimum, that your personal data is adequately protected. We reserve, at a minimum, the right to audit ADP’s security processes and to terminate the agreement if we determine that security is inadequate.
If we share your data with third-party assessment providers as part of the selection process, we will notify you in advance. This notification will include the reasons for sharing your personal data with that third party, as set out herein.
VII. HOW ARE YOUR PERSONAL DATA SECURED?
PMS has implemented appropriate security measures to ensure the confidentiality and security of your personal data. We have implemented appropriate technical, physical, and organizational measures to protect your personal data against accidental or unlawful destruction or accidental loss, damage, alteration, unauthorized disclosure or access, as well as against all other unlawful forms of processing (including, but not limited to, unnecessary collection) or further processing.
VIII. YOUR RIGHTS
You have a number of rights under applicable data protection law with regard to our processing of your personal data. These include:

- the right to request the rectification of any personal data we hold about you;
